Saturday June 6^th, 2009 Time-line

Remember: Mike was NOT required to wear clothing in his bedroom, and all the employees KNEW that he was NEVER to be restrained for ANY reason.

6:00 AM- Jessica Santos is assigned by the supervisor Amiya Harper to Mike, and she signs on as Mikes one-on-one. Mike was agitated about his clothes.

From Jessica Santos Statement – (6/10/09 @ 11:20 AM) Mike went into the laundry room, looking for his clothes, and stripped. He tried to leave, and she stepped in front of him, he opened the door a little and hit his head causing a bleeding cut to the front of his head. Ms Santos stated that Mike became agitated when “he saw the blood rush from his head”.

6:25 AM - Ms Santos reported his injury, and then helped Mike take a shower, then they checked on his clothes again, but they were still wet. After 5-10 minutes, they got his clothes, and went to his bedroom, where she helped him get dressed, and Mike went back to the front (day room), but he was still agitated.

She made several attempts to give him things (personal belongings) that would satisfy him, but he was still agitated. They went back to Mike’s bedroom, he undressed and they went back to the shower-room, and he took another shower. Mike got dressed, and then they went to the front (dayroom) and watched TV for a little while.

Then Mike began getting undressed again so they went to the laundry room, where he stripped, and put his shirt in the dryer. A short time later he put his clothes back on, and returned to the front (dayroom).

8:00 AM – The nurse (LVN Lupe) examines Mikes head wound, and filled out an injury Report.

8:30 AM – Dr. Shipley Does follow up on Mikes head injury.

9:00 AM – From Mr. Stevenson’s statement (9/11/09 @ 9:40 AM).  Returned from walk with Craig Stevenson, Donnell Smith asked if Mike was still agitated, and followed Mike & Mr. Stevenson back to Mikes’ bedroom. When Mike tried to leave his bedroom, Mr. Smith put him in a “standing baskethold”, and then took Mike down on his bed, on his side. Mr. Stevenson then held Mikes legs. After about 5-10 minutes, Mr. Stevenson looked up at Mikes’ face and he was choking, so he told Mr. Smith to stop. Mr. Stevenson stated that “Mikes’ face was blue, and that there was a towel around Mikes’ neck, and that Mr. Smith had a-hold of it.” Mr. Smith then stated “he’s still going to be agitated”, and left the room.

From Donnell Smiths statement, he stated that he was in the front, and heard Mike “screaming” and went to check on him, and Mr. Stevenson. When he opened Mike’s bedroom door, Mr. Stevenson was standing over Mike, and Mikes’ legs were lying on his bed, and his “upper body” was lying on the floor. Mr. Stevenson told Mr. Smith, “I’ve got him, he is OK D”. Mr. Smith returned to the front. Soon Mike and Mr. Stevenson returned to the front (day room), and Mike was wearing a black t-shirt that was torn from the collar, to the shoulder.

About 10:00 AM – Mr. Stevenson helped Mike shower again, and they went on a walk.

10:45 AM.  Mr. Stevenson, and Mike returned, Mike wanted to shower again, so they went to his bedroom, and Mike got undressed.  (No Shower?)

Mr. Stevenson states, Mike was trying to leave his bedroom without clothes because his clothes were being washed, and that Donnell Smith grabbed the blanket from another client's bed, and wrapped it around Mike, causing him to fall to the floor. Mike was laying on his back, in the blanket, and Mr. Smith laid his body on Mikes’ stomach.

Mr. Smith’s statement says that Ms Harper (his supervisor) told him “Boo Boo are you laying on him?” He responded "I'm just laying here picking my nails" then she told him “Do what you do then” and left.

When Ms Santos returned (15 -20 minutes later) About 11:00 AM Donnell Smith said “we’re not going to deal with him”, and he picked Mike up, and placed him on his bed. Mike was lying there and Ms Santos stated that Donnell Smith “was sitting on him, like on his lap, like with my butt” and “he was singing a song, and mocking him, imitating the sounds he (Mike) was making”.

Mr. Smith left and went to get Ms Henderson, a more senior staff, and told her “I thought Mike was really settled down, he was just laying there”. Ms Henderson went to get Mike some shirts, and when she entered Mike’s room, he was setting on his bed, and was alert.

At 11:05 AM Donnell Smith told Ms Santos “I’ll deal with him”, Donnell Smith then removed his "keys" from around his own neck, and told Ms Santos "you go get mike some clothes", so she TOLD him (Mr. Smith) to “sign onto” Mike, (WHY?) and then she went to go get Mike some clothes. When Ms Santos returned Donnell Smith picked Mike up off the floor, and “placed” (later she said SLAMMED head first) him on his bed, his feet were off the bed, and Mr. Smith “lay on him” while she put Mikes’ lower clothing on him. When they let Mike get up again, Donnell Smith put a grey shirt on Mike, then Mike stood up on his bed and tried to remove the shirt, Donnell Smith pulled down on the shirt to stop him, but it tore at the shoulder. Mr. Smith again told Ms Santos to go get Mike another shirt, and she was gone again for 3-5 minutes.  Upon returning Ms Santos stated that Mike was “asleep” on the floor, he was no longer wearing the grey shirt, and Donnell Smith walked out of the room without saying a word. (Amiya Harper saw him walk to the “front”). Seconds later he returned with Abrisha Henderson. Donnell Smith hit Mike on the arm, and Ms Henderson went to get FOUR MORE shirts for Mike. “Donnell Smith picked Mike up from the front, (facing each other), and walked at a normal pace to Mikes bed, Mike didn’t move, and his feet were dragging on the floor”.  He then “shoved” Mike onto his bed, but tripped, and had to catch himself before he fell onto Mike. Mikes head was by the wall, and his legs were folded up. Donnell Smith got his arms out from under Mike, and then “lay on top of him”, from the ribs down. Ms Henderson replaced one of Mike’s shoes that had fallen off. Mr. Smith stated that he “thought Mike had fallen asleep, because he stopped struggling, and was making a “snoring” sound.

Jessica Santos states “at this point Mike looks dead to me”. Ms Henderson and she stared at each other in shock. Ms Henderson stated that “he looks like a dead fish”, and "I said yeah he does”. Ms Henderson put her head to Mike’s chest, and said “he sounded like a hollow box”.

Abrisha Henderson states that she was assigned to another client, and was “in the back” to check on him (next door to Mikes bedroom) when she heard “a Noise that sounded like a smack” and went to check on it. She said that Mike was lying on the floor, Mr. Smith was kneeling by him, and that Jessica Santos was in the room.  She said that Mikes color “looked dark grayish blue”, she told Donnell Smith “he looks like a dead fish”, and she went to get Amiya Harper (the supervisor).

She described Mike as “stiff, with his chest up”, and that Donnell Smith “was in shock - or in a panic”.

11:55 AM – Abrisha Henderson went to Amiya Harpers office and asked her to check on Mike, because he wasn’t responding, Ms Harper told her “quit playing around”, but after a few minutes, they both went to Mikes bedroom where Donnell Smith was kneeling beside Mike, she couldn’t find a pulse, and told Mr. Smith, and Ms Henderson to start CPR. Mr. Smith insisted that Mike was OK, and had a pulse.

12:00 PM – Amiya Harper came into the dayroom, and asked staff to “take the guys outside”.

12:09 PM – According to Sherri Tadlock, (of Risk Management), EMS was called at 12:09 PM.

12:10 PM – Ms Harper called the campus coordinators and told them that Mike Nicholson was non-responsive. Ms Nickerson, and Ms Darling “Ran” to Fir Dorm. They saw that Mike was on the floor, and was blue. Mr. Smith was doing breathing, and Ms Henderson was doing chest compression. The nurses took over.

12:14 PM – (Ms Harper called 911 According to “Dorm Notes”)

12:20 PM – EMS arrived, and The RN shift supervisor stated that Mike's body was "Riggored" (according to “Dorm Notes” this is when campus coordinators, and nurses arrived)

12:22 PM – Mike pronounced dead.

(According to “Dorm Notes” EMS arrived at 12:28 PM)

#1. Why was Mike wearing a BLACK tee shirt when the coroner carried away his dead body? It could not have been placed on him, WHILE Donnell Smith was laying on him! WHEN was in put on him?

#2. What was Jessica Santos doing, during the two hour period (about 8:30 AM – 10:30 AM) that Mike was “on walks”, or showering (under the care of) with Mr. Stevenson?

#3. Craig Stevenson was NEVER “signed onto” Mike.

#4. It is noted by the investigator that additional logs “appear to be MISSING”.
